HARTMAN SIMONS SPONSORS 5/10K RACE (September 25, 2010)
Hartman Simons is a sponsor of the Doug Kessler Lightning 5K/10K, held in conjunction with the 25th Annual Sandy Springs Festival (September 25-26). Attorneys Abbye Goodling and Jackie Watson along with Rachelle Jones, human resources administrator, will join hundreds of runners on Saturday, September 25 to race through the Sandy Springs community. Following the race, the Festival will feature an artist's market, business and civic expo, children's park, collector's car show, Kiwanis pet parade, live entertainment, Whole Foods Heritage Homegrown Market and much more. APPEAL-ING METHODS FOR PROPERTY TAX ASSESSMENTS (September 16, 2010)
In May 2010, Governor Perdue signed Senate Bill 346 (SB 346) into law. This bill codified a comprehensive and uniform property tax appeal process. In an article for Atlanta Commercial Properties, Hartman Simons outlines the three options now available to property owners to appeal a tax assessment. HS SPONSORS NAIOP'S HAPPY HOUR (July 13, 2010)
Georgia's NAIOP chapter braved storms and politicians to pack Sweetwater Brewery for a summer happy hour to raise funds in support of the organization's political action committee "Georgians for Smart Growth." The event drew a handful of candidates for statewide office, including Attorney General Candidate Sam Olens and Secretary of State Candidate Brian Kemp. Hartman Simons co-sponsored the event.
REDEVELOPMENT OF DOWNTOWN TEMPLE TERRACE CONTINUES (July 1, 2010)
On July 1, 2010, the redevelopment of Temple Terrace's Downtown took another step forward as The Vlass Group finalized a joint venture with Inland to redevelop a 95,000-square foot retail center at the core of commercial district of Temple Terrace, Fla. Hartman Simons represented Vlass Temple Terrace, LLC (a joint venture of The Vlass Group, MJ Lant Developments, Inc. and Marketplace Advisors) in the joint venture with Inland Diversified Real Estate Trust Inc. The initiative is part of a 29-acre, multi-phased greyfield project to develop a $150-million downtown City center that incorporates retail, residential, office, restaurant and civic/cultural components. Over the past two years, the Hartman Simons legal team comprised of Peter Hartman, Dan Hicks, Ted Sandler, Clinton Cole and Josiah Bancroft have represented Vlass in the acquisition, development and leasing of the downtown area. Vlass Temple Terrace, LLC acquired the 29-acre, riverfront site in July 2009 from the City of Temple Terrace.
HS PARTNERS SPEAK AT LANDLORD TENANT LAW SEMINAR (June 15, 2010)
Partners Jeffrey Dehner and Benno Rothschild, Jr. shared their expertise at the "Landlord Tenant Law Update" seminar presented by Sterling Education Services. Rothschild emphasized the increased importance of subordination and non-disturbance agreements within the new credit climate as the number of landlord defaults climbs. Dehner outlined the emergence of green building regulations as well as voluntary certification programs. He emphasized the importance of crafting the appropriate contract and lease provisions in order to address new sustainable requirements.
HARTMAN SIMONS REPRESENTS EQUITY GROUP IN ACQUISITION OF DISTRESSED SHOPPING CENTERS (June 2010)
Hartman Simons represented Altus Real Estate Advisors, LLC in the purchase of two distressed shopping centers in Atlanta. The shopping centers were sold by a court-appointed receiver acting on behalf of a special loan servicer, which was administering the original, non-performing acquisition loans on both centers. Andrew Litvak and Paralegal Cheryle Bettis handled all aspects of the legal representation. The transaction also included the restructuring and assumption of existing debt on each shopping center.
PARTNER GIVES OPINION ON REGULATIONS OF COAL ASH MANAGEMENT (May 4, 2010)
The US Environmental Protection Agency proposes regulation of the disposal and management of coal ash from coal-fired power plants. Law 360, the industry's leading news wire, outlined both propositions. Hartman Simons Partner Jeff Dehner indicated that the regulatory regime proposed under Subtitle D would be more “performance-based,” while Subtitle C would be more strict, requiring additional record-keeping and permits. Hartman Simons represents Arrowhead Landfill in Perry County, Ala., one of the premier facilities in the eastern United States for management of coal ash. more >
HARTMAN SIMONS RAISES $62,000 FOR LANCE ARMSTRONG FOUNDATION (April 17, 2010)
Hartman Simons raised over $62,000 at its third annual Charity Golf Classic at Cherokee Country Club, benefitting the Lance Armstrong Foundation. Over 150 players showed their support on the course with Steve Bartkowski, former Atlanta Falcons All-Star Quarterback, serving as honorary chairman of the event. This charity event is one of only three tournaments held throughout the country to support the non-profit organization.

PARTNER PARTICIPATES IN BROWNFIELD PROGRAM (March 23, 2010)
Experts from around the United States shared their insights on brownfield development at the National Brownfield Association’s national forum in Atlanta. Partner Clinton Cole participated in the Regulatory Program “Reports from the Field” where discussion outlined various brownfield programs. The advantages and disadvantages of privatized programs were discussed and compared to more traditional “command and control” programs. Further conversation showcased what “works” from a private sector perspective for developers, owners, tenants and lenders.
