Jill R. Johnson co-authored a two-part article in Retail Law Strategist regarding the impact of O.C.G.A. §13-1-11 on prevailing party fee provisions in commercial lease agreements. The series was entitled: Georgia Supreme Court Severely Limits Landlords' Recovery of Attorney Fees in Georgia – Parts 1 & 2.
DAILY REPORT DETAILS COSTCO NEGOTIATIONS AT NORTH DEKALB MALL

The Daily Report recently featured the challenges facing Hendon Properties, under the counsel of Hartman Simons, as it works to redevelop North DeKalb Mall in Decatur, GA. The developer seeks to ink a deal with Costco Wholesale Corp., but, despite considerable negotiations, legal and business issues have thwarted the lease.
Hartman Simons Partner Theodore H. Sandler explained North DeKalb Mall’s unusual zoning situation with the majority of the property zoned for commercial development and one section zoned for neighborhood-commercial, which prohibits gasoline sales – a notable part of Costco’s business.
Additional issues include the finalization of Hendon’s plans to redesign the mall, the potential acquisition of the Macy’s-owned building and required setbacks from nearby wetlands.
