HARTMAN SIMONS REPRESENTS BANK IN $100 MILLION ASSET DISPOSITION

Hartman Simons represented Bank of North Georgia in the June bulk sale of promissory notes and foreclosed properties held by the bank. With the assistance of Hartman Simons Partners Gil Burstiner, Charles "Buzz" Wood, Keith Wilson and Yvette Fallone-Tietje, the bank grossed more than $100 million in aggregate sales proceeds. On behalf of the bank, Hartman Simons effectively negotiated the purchase agreements, prepared the necessary conveyance and loan documents and successfully consummated over 75 separate commercial real estate closings within 12 days.

Lori Kilberg was recognized by CREW for her extraordinary commitment to doing and referring business with fellow CREW members, thereby exemplifying the spirit of CREW-Atlanta and CREW Network. Since she joined the organization in 2002, she has been actively involved in several CREW committees, served the Atlanta Chapter as the Programs chair in 2006 and as a member of the Board of Directors in 2007-2008. DAILY REPORT FEATURES OBSTACLES OF SEMBLER SHOPPING CENTER (March 26, 2009)
The Daily Report recently detailed the challenges overcome by The Sembler Co., the firm’s client, and Hartman Simons, to open Canton Marketplace in Cherokee County, Georgia. Despite a difficult economy, Sembler worked with Hartman Simons Partners Robert D. Simons, Jeremy D. Cohen, Ashley Stanley and five other Hartman Simons attorneys to ensure the 800,000-square foot power center opened as scheduled.
“The project was a mountain,” explained Simons. Hartman Simons has worked on the project since 2004, overcoming significant obstacles, such as moving 2.4 million cubic yards of dirt, retailers filing for bankruptcy protection and the lockdown of the global credit markets. However, none of the factors was enough to sabotage the project. Canton Marketplace, along with its anchors SuperTarget, Lowe’s Home Improvement and Kohl’s, celebrated the grand opening in March.
DAILY REPORT FEATURES HARTMAN SIMONS WORK ON APARTMENT DEAL

The Daily Report recently reported that Newport Development, LLC retained Hartman Simons Partner Yvette Fallone-Tietje to facilitate negotiations for the acquisition of two parcels in Technology Park/Atlanta Johns Creek. The developer plans to develop an apartment complex. In 2008, Johns Creek City Council rejected Newport’s previous application to rezone other property in Johns Creek to permit residential use. This is the second site Newport Development, LLC has had under contract in Johns Creek.
HARTMAN SIMONS PREVAILS IN GEORGIA COURT OF APPEALS (March 11, 2009)
Chris Badeaux and Kristen Yadlosky prevailed in the Georgia Court of Appeals in the case of Meadow Springs, LLC v. IH Riverdale, LLC, et al., (Case No. A08A2030, March 11, 2009), a decision reaffirming that the filing and publication of a lis pendens is privileged as long as the lis pendens itself is proper.

Jeff S. Dehner was re-appointed by the International Council of Shopping Centers (ICSC) to serve as the Georgia Government Relations Chair. In this capacity, Mr. Dehner serves on the ICSC Georgia Executive Board and is responsible for tracking and reporting on legislative and political developments affecting the retail development industry at the local, state and national level.
