Mr. Brake represents both developers and lenders and is head of the firm’s Investment & Finance practice area. Mr. Brake’s development expertise includes shopping centers, apartment complexes, office buildings, office parks, industrial buildings and industrial parks. In the course of representing his developer clients, Mr. Brake has handled all aspects of the development process, including land acquisition, construction issues, financing (construction, mezzanine and permanent loans), partnership and joint venture formation, lease negotiations, outparcel development and sales, and dispositions.
On the lending side, Mr. Brake’s practice includes both front-end loans on all property types as well assisting his clients with troubled assets. As such, Mr. Brake’s expertise involves acquisition and development, construction, rehab, permanent, mini-perm, and securitized loans; sale-leaseback transactions; intercreditor, tri-party and take-out agreements; bankruptcies, forbearance agreements, workouts and foreclosures; and sales of REO and distressed loans.
